The parentage will be established for the woman who has given birth via its designation in the act of birth, and the one that has not carried the baby by the joint recognition.

The national Assembly has re-validated Thursday night the delicate reform of the filiation linked to the opening of the LDCS for all women, the right denouncing a “profound shock” resulting from a “diy”.

This reform, passed in the second reading of the bill on bioethics by 62 votes to 15, is the result of the opening of the medically assisted procreation (PMA) for lesbian couples and single women, a leading measure of the text confirmed on Wednesday evening. Female couples will have to go through a recognition early of the child before a notary public, the same way as the heterosexual couples who are not married.

The parentage will be established in respect of the woman who gave birth through its designation in the act of birth, whereas one who has not worn the baby will be by the joint recognition. The couples of women who have had recourse to a PMA abroad before the act may also, for three years from the publication of the text, make a joint recognition for establishing parentage. The minister of Justice Eric Dupond-Moretti is committed to working with situations not provided for in the state, as in the case where the couples are separated from the LDCS.

A “real revolution”

“The law must take into account the evolutions of the society,” he argued, conceding in a formula give rise to annoyance to the right that the text “disrupts the civil Code who knew that ‘mom and dad'”. The co-rapporteur Coralie Dubost (LREM) has also considered the procedure of adoption “to reverse the entire philosophy of the text”.

“The woman who gives birth is the mother. But the woman who gives birth, but who from the beginning was in the parental project is the mother just as much. (…) We do not want a second mother to adopt her own child”, supported by Aurore Bergé (LREM).
