Discrimination in employment, housing, education or police controls : the Defender of Rights, Jacques Toubon, critical of “the failure of public policy” on this issue, and calls for the creation of an “observatory on discrimination”, in a report published on Monday.
“The people of foreign origin or perceived as such are disadvantaged in access to employment or housing and greater risk of unemployment, the precariousness, the bad housing, police checks, health gradient, and inequality in school,” says Jacques Toubon, which underlines the “systemic dimension” of discrimination in France, putting into question the “fundamental rights” of “millions” of people “and” social cohesion”.

To him, “discrimination is not the result of logical individual, of a few HR managers who refuse to hire black people or arabs,” but “it is the whole system that is in cause”. “Failure of public policies”
The report, entitled “Discrimination and origins : the urgency to act,” point a finger “the failure of public policy” in the matter, “erased in favour of the promotion of diversity or issues of security, secularism and the fight against hatred”. “The fight against discrimination is not the subject of a coordinated policy and specific,” says the Defender, with the hope that this topic can become a “policy priority ambitious”, with the image of equality between women and men.
Observatory of discrimination and national campaigns of “testing” concerning, in particular, employment, housing : Jacques Toubon wants to “better inform” the topic, but also a “review of the texts governing identity checks to ensure their traceability”.

The former keeper of the Seals also recommends that “to facilitate the proof of discrimination in the criminal field” and “ensure judicial sanctions are proportionate and truly dissuasive sanctions against perpetrators”. Its goal : “to reduce the proof required in criminal matters and by allowing the civil court to award punitive damages in cases of direct discrimination and harassment”.
