The Parliament definitively adopted Thursday, by a final vote by the Senate, a bill LREM allowing employees to “donate” leave in the form of cheques-holiday for caregivers. The allocation of cheques-holiday will be reserved for staff, including temporary employees and trainees, whose income does not exceed three times the Minimum wage. The beneficiary must have worked during the period from 12 march to 10 may, corresponding to the period of confinement of the population to cope with the epidemic of sars coronavirus.

In practice, until 31 October, an employee may waive one or more days of accrued leave within a limit set by decree, against the payment by his employer of a sum of money to the national Agency for chèques-vacances (ANCV). This agency will allocate then the cheques-holiday in the “facilities and services, health, medico-social and assistance and support in the home”. At the initiative of the Senate, the funds created within the ANCV can also be powered by a donation of remuneration, corresponding to “one or more days of work.”

A collective agreement of a company may provide a matching contribution of the employer in addition to these payments. A decree will determine the conditions of application of the device to public agents. The dedicated account of the ANCV can still be fed through donations made by any natural or legal person”.

The criticism from the opposition

“This proposed act is certainly a generous intention, but it does not correspond to the expectations and demands of health care providers,” said the rapporteur LR Frédérique Puissat. The new minister responsible for Insertion Brigitte Klinkert has defended “a form of solidarity essential” to the caregivers. By supporting the tourism, the text “made up of a stone two blows”, she said. The proposed legislation “may not substitute” to the health system reform initiated by the government, “it is just one more”, for its part, pointed out Martin Wolfhound (LREM).

The left has voted against it. Senator Cathy Apourceau-Poly (CRCE-majority communist) denounced a “false solidarity”, while the socialist Bernard Jomier, pointed to a bill as incomplete, blurred, complex to implement and very likely destined for failure”.
