A man who died nine days before the first round of the municipal has been elected. The justice has confirmed his election.

The case is, to say the least unusual. The administrative court of Bastia has validated the election of a city councillor who died, in the town of Pietra-di-Verde, Haute-Corse, reports The verge. In total, 22 candidates were in the fray in the first round of the municipal elections in this tiny village of less than 1000 people voting at the ballot plurinominal. On march 15, eleven advisers have been appointed.

Problem, one of them died on 6 march, nine days before the election. His death occurred between the time of the closing of nominations and the first round of voting. Still, this has not prevented the little village to vote for him, the latter raising even the comfortable score of 57% of the vote.

“there is no place to cancel the election of that councillor”

Faced with this situation preposterous, the prefect of Haute-Corse has entered on march 20, the administrative court of Bastia to cancel the election of a city councillor. The representative of the State asked to proceed to a second round, to assign the seat left vacant. But his application was confronted with a legal vacuum, which has led the court to nonsuit his action.
