Justice has dismissed the case in the case of Ary Abittan, accused of rape and indicted since 2021. The student who accuses him, however, announced her desire to appeal.
Actor and comedian Ary Abittan benefited from a dismissal of charges this Tuesday April 2, 2024 in the rape case in which he had been involved since 2021, the Paris prosecutor’s office confirmed after initial information obtained by Le Figaro. This is a new step towards the end of the investigations, since the actor had already obtained the abandonment of his indictment in July 2023.
Ary Abittan’s lawyer said she was “delighted” for the actor of What We Did to the Good Lord?, and “hopes that he will finally be able to devote himself to his career, and that the cinema will extend its hand to it again.” Conversely, the plaintiff’s lawyer, Maître Charlotte Plantin, announced her client’s decision to appeal to the investigating chamber. It will be up to this institution to rule on the case, by exonerating the actor or by referring the actor to the departmental criminal court, Le Figaro tells us.
As a reminder, a 23-year-old student at the time of the facts, who was then dating the actor, accuses him of having imposed non-consensual sodomy on her on October 30, 2021. She filed a complaint in the hours that followed, accusing him of ” a degrading and non-consensual sexual relationship. Ary Abittan was indicted for rape and placed under judicial supervision a few days later, in November 2021.
But in July 2023, the indictment was abandoned, and the actor found himself only placed under the status of assisted witness. The prosecution specified that at that time, the investigating judge had “estimated that there was no longer enough consistent evidence to justify an indictment status”, due to “the absence of serious or consistent evidence in favor of an act of sexual penetration imposed by violence, coercion, threat or surprise,” revealed their order revealed by AFP at that time.
They then described, with testimony from Ary Abittan’s former companions, a “respectful partner” and psychiatric and psychological expertise which did not “reveal any personality elements in favor of a deviant sexuality or aggressive sexual urges. Conversely, the two investigating judges recognized that the complainant suffered from “indisputable” post-traumatic stress.
